1. Agreement to Terms
By downloading, accessing, or using Anchor ("the App" or "Service"), you ("you" or "User") agree to be bound by these Terms of Service ("Terms"). Anchor is owned and operated by Arc Transformation LLC ("we," "us," or "our"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Anchor is a mobile application designed to help families of children with autism and other developmental needs. The App provides visual routine management (the Rhythm module) and will expand to include IEP support (Ally) and behavior tracking (Compass) in future releases.
The App is intended for use by parents and guardians, with children using it under supervision.
3. Eligibility
You must be at least 18 years old and legally able to enter into contracts to create an account. By creating an account, you represent and warrant that:
- You are at least 18 years old
- You are the parent or legal guardian of any child whose profile you create
- You have the authority to consent to the collection and use of your child's information as described in our Privacy Policy
- All information you provide is accurate and complete
4. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Ensuring information about children in your account is accurate and current
- Supervising your child's use of the App
We are not liable for any loss or damage arising from your failure to safeguard your account.
5. Acceptable Use
You agree NOT to:
- Use the App for any illegal purpose or in violation of any laws
- Attempt to gain unauthorized access to the App, our servers, or other users' data
- Reverse engineer, decompile, or disassemble the App
- Use the App to harm, harass, or exploit children (yours or others)
- Upload content that is offensive, obscene, or violates others' rights
- Interfere with or disrupt the App's functionality or security
- Use automated systems (bots, scrapers) to access the App without our written permission
- Impersonate any person or misrepresent your affiliation
- Share your account credentials with others
Violations may result in immediate account termination.
6. Children's Use (COPPA)
Anchor is designed for children to use under parental supervision. We comply with the Children's Online Privacy Protection Act (COPPA):
- Parents must create and manage all child profiles
- We do not knowingly collect personal information from children under 13 without parental consent
- Parents may review, modify, or delete their child's information at any time within the App

If you believe we have inadvertently collected information from a child without parental consent, contact us immediately at privacy@arctransformation.ai.
7. Intellectual Property
Our Property:
The App, including its code, design, graphics, text, and content, is owned by Arc Transformation LLC and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
Your Content:
You retain ownership of any content you create within the App (routine templates, custom tasks, child profiles, etc.). By using the App, you grant us a limited license to store, process, and display your content solely to provide the Service.
Feedback:
Any feedback, suggestions, or ideas you provide about the App become our property and may be used without obligation to you.
8. Subscriptions and Payments
The App is currently free. In the future, we may introduce paid subscription tiers. When we do:
- Subscription terms will be clearly disclosed at the point of purchase
- Payments are processed by Apple (App Store) or Google (Play Store) per their terms
- Subscriptions auto-renew unless cancelled
- Refunds are handled per platform policies (Apple/Google)
- We reserve the right to change pricing with reasonable notice
9. Privacy
Your use of the App is also governed by our Privacy Policy, available at arctransformation.ai/privacy. By using the App, you consent to our data practices as described in the Privacy Policy.
10. Third-Party Services
The App uses Supabase for data storage and authentication. Your use of these third-party services is subject to their respective terms. We are not responsible for third-party services' availability, accuracy, or content.
11. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
We do not warrant that:
- The App will be uninterrupted, error-free, or secure
- Any errors in the App will be corrected
- The App is suitable for any particular purpose
- Results from using the App will meet your expectations
The App is not a medical device. It is a productivity and organization tool for families. It is not intended to diagnose, treat, cure, or prevent any medical condition. Always consult qualified healthcare professionals for medical advice regarding your child.
The App does not replace professional care. It supplements but does not replace therapy, education, or medical treatment. It is not a substitute for direct care, supervision, or emergency services.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARC TRANSFORMATION LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to:
- Loss of data
- Loss of profits or revenue
- Personal injury or property damage
- Emotional distress
- Cost of substitute services
Our total aggregate liability to you for all claims arising from or related to the App shall not exceed the greater of (a) the amount you paid us in the past 12 months, or (b) one hundred US dollars ($100).
This limitation applies regardless of the legal theory (contract, tort, warranty, etc.) and even if we were advised of the possibility of such damages.
13. Indemnification
You agree to indemnify, defend, and hold harmless Arc Transformation LLC, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Content you submit to the App
14. Termination
We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violations of these Terms.
You may terminate your account at any time by deleting it from within the App.
Upon termination:
- Your right to use the App ceases immediately
- We may delete your account data (subject to Privacy Policy retention terms)
- Sections of these Terms that should reasonably survive termination will remain in effect
15. Governing Law and Dispute Resolution
Governing Law:
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
Informal Resolution:
Before filing any legal action, you agree to contact us at legal@arctransformation.ai and attempt to resolve the dispute informally for at least 30 days.
Arbitration:
ANY DISPUTE NOT RESOLVED INFORMALLY SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Travis County, Texas (or remotely at arbitrator's discretion).
You waive your right to:
- A jury trial
- Participate in a class action or class arbitration
- Consolidate claims with other users
If arbitration is found unenforceable, disputes shall be resolved in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction there.
Exceptions:
This section does not apply to:
- Claims for injunctive relief to protect intellectual property
- Small claims court actions
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Posting the updated Terms in the App
- Updating the "Last Updated" date at the top
- Sending email notification for significant changes
Continued use of the App after changes constitutes acceptance. If you disagree with changes, you must stop using the App.
17. Miscellaneous
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect
- No Waiver: Our failure to enforce any right or provision is not a waiver of that right
- Assignment: You may not assign these Terms; we may assign them freely
- Force Majeure: We are not liable for failures due to circumstances beyond our reasonable control
